1. Who we are and agreement

These Terms of Use ("Terms") govern your use of Pipe Press at pipepress.app and any related pages (the "Service"), operated by the Pipe Press project ("we", "us"). By ticking the box and selecting "I agree", or by using the Service, you agree to these Terms, the Health & Safety Notice and the Privacy Notice. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years old. If you are under 18 (or the age of majority where you live), you may use the Service only with the permission of a parent or legal guardian, who agrees to these Terms on your behalf.

3. The Service

The Service is a free browser game that uses your device's camera and an on-device pose-estimation model to follow your movements during push-ups. We may change, suspend or discontinue any part of the Service, including leaderboards, at any time without notice.

4. Use at your own risk; get medical advice

You should consult a doctor before using the Service or starting any exercise programme. Physical exercise carries an inherent risk of injury, including muscle strains, joint injuries, falls and, in rare cases, serious medical events. You take part voluntarily and at your own risk. You are solely responsible for deciding whether the activity is suitable for you, for your environment and equipment, and for following the Health & Safety Notice.

5. Leaderboards, names and fair play

• You may submit a player name (3–12 characters) with a qualifying score. Names and scores are shown publicly.
• You must not submit names that are offensive, hateful, sexual, harassing, impersonate others, or infringe anyone's rights.
• You must not cheat or interfere with the Service. That includes modifying the game code, submitting fabricated or manipulated scores or data, automating gameplay, using pre-recorded or virtual camera feeds for ranked play, circumventing security or rate limits, or attacking or overloading the Service.
• We may remove any name or score, reset leaderboards, or block access at our sole discretion, without notice and without giving a reason.
• By submitting a name you grant us a worldwide, royalty-free, non-exclusive licence to display it with your score as part of the Service.

6. Intellectual property

The Service, including its code, art, music, sound and text, belongs to us or our licensors and is protected by intellectual-property laws. You may use the Service for personal, non-commercial play. You may share the share-card images the Game generates. You may not copy, modify, distribute, sell or reverse-engineer the Service except as the law expressly allows.

Pipe Press is an independent game. It is not affiliated with, endorsed by or sponsored by the owners of Flappy Bird or any other game or brand. All third-party trademarks belong to their owners.

Open-source components are used under their licences; see /licenses.

7. No warranty

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, and uninterrupted or error-free operation. We do not warrant that rep counts, tracking, form cues, scores or leaderboards will be accurate, that the Service will work on your device, or that it will be free of bugs, viruses or other harmful components.

8. Limitation of liability

To the maximum extent permitted by law:

• we are not liable for any personal injury, illness or death, or for any damage to your device or other property, arising out of or in connection with your use of the Service or your exercise;
• we are not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, profits, goodwill or opportunity;
• the Service is provided free of charge, and we accept no liability of any kind for any loss or damage arising out of or in connection with it.

The only exception is liability that the law does not allow anyone to exclude, for example (depending on where you live) liability for death or personal injury caused by negligence, for fraud, for gross negligence or wilful misconduct, or under mandatory product-liability or consumer law. Where such liability exists, it applies only to the minimum extent the law requires.

9. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from any claims, losses and costs (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or content you submit.

10. Third-party services

The Service uses Cloudflare (hosting, security and Turnstile bot protection). Your use of those features is also subject to Cloudflare's terms and privacy policy. We are not responsible for third-party services.

11. Changes

We may update these Terms. The version date is shown at the top. If we make material changes, the app will ask you to accept the new version before you continue playing.

12. Governing law and disputes

These Terms are governed by the laws of the operator's place of establishment, without depriving you of the protection of mandatory consumer laws, or of your right to bring proceedings, in your country of residence.

13. General

If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. These Terms, the Health & Safety Notice and the Privacy Notice are the entire agreement between you and us about the Service.

The Service is operated anonymously and has no support channel.
